Terms of Service

Welcome to Foti. These Terms of Service ("Terms") govern your access to and use of the Foti mobile application (the "App") and all related services provided by Foti ("we", "us", or "our") in Timor-Leste. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
By creating an account or using any of Foti's services, you confirm that you are at least 18 years of age and that you accept and agree to comply with these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
Foti provides an on-demand technology platform that connects users with independent transportation and delivery service providers. Our services include:
- Foti Ride: Motorcycle ride-hailing service for quick and affordable point-to-point transportation across Timor-Leste.
- Foti Car: Car ride-hailing service for comfortable and convenient travel, suitable for longer distances or group travel.
- Foti Send: On-demand package and document delivery service. Send items from one location to another using our network of drivers.
- Foti Store: Browse and order products from local stores and have them delivered to your doorstep.
Foti acts solely as a technology platform that facilitates connections between users and independent drivers. Foti does not provide transportation services directly and is not a transportation carrier or logistics company.
3. User Accounts
To use Foti's services, you must create an account. By creating an account, you agree to the following:
- Registration: You must provide accurate and complete information during registration, including a valid phone number. You may also sign in using your Google account.
- Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
- One account per person: Each individual may maintain only one Foti account. Creating multiple accounts may result in suspension or termination of all associated accounts.
- Accurate information: You must keep your account information up to date. We reserve the right to suspend accounts that contain false or misleading information.
4. User Conduct
When using the App, you agree not to:
- Engage in fraud: Use the App for any fraudulent purpose, including creating fake ride requests, manipulating fares, or exploiting promotional offers dishonestly.
- Abuse or harass: Engage in abusive, threatening, or harassing behavior toward drivers, other users, or Foti staff. This includes physical threats, verbal abuse, and discriminatory conduct.
- Transport illegal goods: Use Foti Send or any other service to transport illegal, hazardous, or prohibited items, including but not limited to drugs, weapons, explosives, or stolen property.
- Impersonate others: Use another person's account, impersonate another individual, or misrepresent your identity in any way.
- Interfere with services: Attempt to disrupt, manipulate, or interfere with the App's functionality, servers, or networks.
- Violate laws: Use the App for any purpose that violates applicable laws or regulations in Timor-Leste.
5. Payments and Pricing
The following terms apply to payments and pricing on the Foti platform:
- Fare calculation: Fares are calculated based on distance, estimated travel time, service type, and current demand. The applicable fare is displayed in the App before you confirm your ride or delivery request.
- Price transparency: The estimated fare is shown to you before you confirm a booking. While actual fares may vary slightly due to route changes or traffic conditions, any significant deviation will be communicated.
- Cash payment: Foti currently operates on a cash payment basis. You agree to pay the displayed fare directly to the driver upon completion of the ride or delivery.
- Cancellation fees: If you cancel a ride after a driver has been assigned and is en route, a cancellation fee may apply as displayed in the App.
- Promotions and discounts: Foti may offer promotional fares or discount codes from time to time. These are subject to their own terms and conditions and may be modified or withdrawn at any time.
6. Driver Responsibilities
Drivers using the Foti platform must adhere to the following requirements:
- Valid license: All drivers must hold a valid driver's license issued by the appropriate authority in Timor-Leste for the type of vehicle they operate.
- Vehicle safety: Drivers are responsible for maintaining their vehicles in safe and roadworthy condition. Vehicles must meet all applicable safety standards and pass any required inspections.
- Insurance: Drivers are encouraged to maintain appropriate vehicle insurance coverage as required by the laws of Timor-Leste.
- Professional conduct: Drivers must provide courteous, professional service and follow the most efficient route unless otherwise directed by the rider.
- Compliance: Drivers must comply with all applicable traffic laws and regulations while providing services through the Foti platform.
7. Safety
The safety of our users and drivers is a top priority. All users of the Foti platform must adhere to the following safety requirements:
- No drugs or alcohol: Users and drivers must not be under the influence of alcohol, drugs, or any substance that impairs their ability to use or provide services safely. Drivers found to be impaired will be immediately removed from the platform.
- Emergency situations: In case of an emergency during a ride, contact local emergency services immediately. You may also report safety concerns to Foti through the App or by contacting our support team.
- Helmets: For Foti Ride (motorcycle) services, both drivers and riders are required to wear helmets in compliance with Timor-Leste traffic safety regulations.
- Seatbelts: For Foti Car services, all passengers must wear seatbelts during the ride.
- Reporting: Users are encouraged to report any safety incidents, accidents, or concerns through the App's rating and feedback system or by contacting support directly.
8. Limitation of Liability
Foti is a technology platform that connects riders with independent drivers. Foti is not a transportation company, logistics provider, or delivery service. As such:
- Foti does not guarantee the availability, quality, or safety of rides or deliveries provided by independent drivers.
- Foti shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App or services.
- Foti is not responsible for the actions, negligence, or misconduct of any driver or user on the platform.
- To the maximum extent permitted by law, Foti's total liability for any claim arising from the use of our services shall not exceed the amount you paid for the specific service giving rise to the claim.
- The App and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
9. Intellectual Property
All content, trademarks, logos, service marks, trade names, and other intellectual property displayed on or through the App are the property of Foti or its licensors. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our intellectual property without prior written consent. Your use of the App does not grant you any ownership rights to the App's content or features.
10. Termination
Foti reserves the right to suspend or terminate your account at any time, with or without notice, for reasons including but not limited to:
- Violation of these Terms of Service
- Engaging in fraudulent or illegal activity
- Receiving repeated low ratings or complaints from drivers or other users
- Providing false or misleading account information
- Any behavior that threatens the safety of other users or drivers
You may also terminate your account at any time by deleting it through the App (Profile > Delete Account). Upon termination, your right to use the App ceases immediately.
11. Dispute Resolution
In the event of any dispute arising from or relating to these Terms or your use of Foti's services, you agree to first attempt to resolve the matter informally by contacting our support team. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through the competent courts of Timor-Leste. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Democratic Republic of Timor-Leste, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Dili, Timor-Leste, and you consent to the jurisdiction of such courts.
13. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and notify you through the App. Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed about any updates.
